Article 1- Scope
These terms and conditions of sale apply, within the scope of the on-line sales service on Internet provided by the company

to all sales concluded through the www.armorlux.com website, with its non professional customers.

For orders placed from a country other than Metropolitan France, the customer is the importer of the products concerned.
For all products dispatched outside the EEC and the Overseas Departments and Territories, duties and other local taxes may be claimed. These taxes are not the responsibility of ARMOR. They will be borne exclusively by the customer who is advised to make inquiries regarding these aspects before placing an order.
These terms and conditions of sale may be changed at any time providing such changes appear on the website.
Article 2 - Prices
Prices are indicated in Euros, GST included, excluding processing and shipping costs for shipments in the European zone.
For shipments outside the EU and DOM TOM, prices are indicated in Euros, GST excluded. Local GST and importation duties will be requested by the carrier upon reception of your order.
ARMOR reserves the right to change its prices at any time but the products will be invoiced on the basis of the rates in force at the time when the order is recorded subject to availability.
Article 3 - Order
It is incumbent upon the customer to select on the website the products it wishes to order. Payment is made on-line by bank card, or by Paypal. The order is subject to confirmation by email, specifying the references ordered, the amount of the order and the delivery address.
The order will be dispatched at the latest 20 days following receipt of payment.
Article 4 - Acceptance of the terms and conditions of sale
The customer acknowledges that it has read and accepted these terms and conditions of sale before placing its order.Validating the order therefore implies acceptance of the terms and conditions of sale. In the absence of evidence to the contrary, the data recorded by ARMOR constitutes proof of the transaction.
Article 5 - Availability
Product and price offers are valid as long as they are visible on the website, within the limit of available stock.
If a product is unavailable once the order has been placed, the customer will be informed by e-mail as soon as possible.
Only the items that are shipped will be charged to the customer.
Article 6 - Delivery
The products are delivered to the delivery address provided by the customer during the order placement process. Delivery deadlines include preparation of the parcel and shipping.
The order will only be processed once payment is confirmed.
If there is a delay in delivery, the customer can cancel the order.
The customer can track regularly its order and call customer service should it have any questions at +33 (0)2 98 90 10 29.
Article 7 - Delivery charges
Delivery charges are automatically generated during the ordering process. ARMOR applies differentiated delivery rates depending on the amount of the order, the geographical area of delivery and the shipping method.
Delivery charges appear on the order confirmation.
These charges include a contribution to preparation and packaging fees + postage costs + transportation costs. Delivery charges are due for every order placed.
Article 8 - Payment
For on-line payment, the order placement process posted on the website must be followed.
All banking information that you send us are secured by SSL encryption.
Article 9 - Transfer of ownership, transfer of risk.
Transfer of ownership and transfer of risk take place upon delivery of the pre-paid goods. The goods must be checked by the customer upon delivery. Any reservations should be indicated on the delivery slip presented by the carrier or can be sent to the sales department of ARMOR within 72 hours.
In case of defects, return charges will be borne by ARMOR. The defective article will either be exchanged or refunded.
Article 10 - Retraction.
The customer has a period of 15 business days to exercise its right to retract delivery to return the items to ARMOR-LUX for refund or voucher. Please note that the products should be returned in their original packaging and in perfect condition. If we don’t receive your return in time, the return will be cancelled and we will consider the purchase complete. If you wish to return an item, please follow the procedure as indicated on our website or on the documents received with the order.
Return is free if you ordered from one of the following countries: France (mainland), Germany, Belgium, Spain and Luxembourg. Please go to your account and print out your return label. If the order was placed from another country, return charges are on your expense.
Please note that returns of food products are not allowed.
Article 11 - Warranties.
The delivered products are covered, in accordance with legal provisions, by a warranty against latent defects originating from material, design or manufacturing defects and rendering them unfit for use.
No warranty will be provided in case of bad use, negligence or lack of maintenance by the customer.
ARMOR will replace or have repaired the products found to be defective.
The products sold on the website are compliant with the regulations in force in France.
The seller will not be held liable for any delay due to the occurrence of a force majeure event.
Article 12 - Applicable law - Disputes
Please contact the Armor-Lux Customer Service for any claim by clicking the link “contact us” in order to request a settlement agreement.
For any prior written claim to the attention of our Customer Service for less than a year and unsatisfied, in accordance with the provisions of the French Consumer Code concerning the settlement agreement, the customer has the possibility to use the mediation service "Centre de Médiation de la Consommation de Conciliateurs justice (CM2C)" : 14 rue Saint-Jean - 75017 Paris
These general terms and conditions of sale are subject to French law. In case of a dispute, only the French courts will be competent.
Article 13 - Data protection
Pursuant to French law No. 78-17 of 6 January 1978, it is reminded that the personal data requested from the customer are necessary to process its order and are intended for internal use by ARMOR only.
The customer therefore has a right to access, modify, correct and object pursuant to the terms of the law by contacting customer service.
Depending on the choices of the customer in the personal information section, it may receive offers from ARMOR.
SPECIAL CONDITIONS FOR THE SALE OF PERSONALIZED BRETON SHIRTS
Armor-Lux offers to personalize certain Breton shirts (“Marinères”). These Breton shirt will be entirely manufactured on demand in our factories of Quimper in France. The Special Terms and Conditions for the distance selling of these products are described below. All the provisions of the Terms and Conditions of Sale above that are not modified by the present Special Conditions remain applicable.
Article 1 – Ordering process
The order of personalized Breton shirts via the service "Ma marinière" can only be done via the website or www.ma-mariniere.com
The Breton shirts are customized, created and manufactured in our factories at Quimper according to the customer specifications within the sole limit of the choices proposed when ordering. In order to validate his order of one or more personalized Breton shirt, the Customer will have to validate the pre-visualization of the Breton shirt that he chose to ensure compliance, in particular :
- the color of Breton shirt
- the selected position of the marking : left chest, bottom left, left sleeve
- the color of the marking
- the size of the characters
- the typography
- the content of the embroidery message
- the size of the Breton shirt
The validation by the Customer implies full and complete acceptance of the Breton shirt as submitted to Armor-Lux.
The Customer will be solely responsible for the text chosen to proceed to the customization of his Breton shirt. The Customer agrees :
- to respect intellectual property rights (trademarks, copyright, personality rights, etc.)
- to not include any text whose content could be unlawful or contrary to good morals (pornographic, pedophiliac, racist ...)
Armor-Lux reserves the right to cancel an order that does not comply with the above conditions
Article 2 - Delivery
After the confirmation of the order and under restriction of reception of the payment, the “Breton shirt” will be created and shipped within a maximum of 15 working days.
Article 3 : Return and Exchange of personalized Breton shirts
In consideration of the unique and personal nature of the Breton shirt, it cannot be taken back nor exchanged in accordance with article L121-21-8 of the Consumer Code :
"The right of withdrawal may not be exercised, in the case of contracts: (...) 3 ° Supply of goods made according to consumer specifications or clearly personalized ...".
The customer can therefore not resort to his right of withdrawal. Nevertheless, the customer continues to benefit from the guarantees provided in article 11 of the Terms and Conditions of Sale above.
